What to do following an auto accident:
1.) EXCHANGE LICENSE AND INSURANCE INFORMATION with the other drivers.
2.) DO NOT EXPRESS ANY ADMISSION OF FAULT to drivers, witnesses, law enforcement or medical personnel. Legal fault may be disputed, and a determination may need to be made by a judge or jury.
3.) CALL TO THE SCENE AND COOPERATE WITH LAW ENFORCEMENT PERSONNEL. DO NOT simply exchange insurance information and leave the accident scene without speaking with the officers who investigates the accident.
4.) SEEK MEDICAL ATTENTION if you feel you may be injured. Stiffness the day of an accident may indicate injury which will often worsen over time. Fully explain any medical problems you have and complaints of pain to medical personnel.
5.) TAKE PHOTOS of damage to your vehicle and person. This may become important in the event of a dispute over fault or the extent or nature of your injuries.
6.) DO NOT SPEAK WITH AN INSURANCE ADJUSTER without first speaking to an attorney. Any misstatements you make may be used against you later in court. If you must speak to an adjuster before speaking with an attorney, only discuss property damage and, if asked, fully explain any physical symptoms you have. Do not discuss how the accident happened without first speaking to an attorney.
